Georeferenced plan for measuring plots and houses in Moraira, Spain

Georeferenced plan for measuring plots and houses in Moraira, Spain

Nowadays when selling a property in Moraira, it is necessary to make a geo-referenced plan with the coordinates of the house and the plot, so that the title deeds, the land registry and the land registry have the same information.

What is the georeferenced plan in Moraira, Spain for the land?

It is a document drawn up by a competent professional in Topography and Geomatics that is used to require the correct registration or update in the Cadastre or Land Registry, currently coordinated by the Mortgage Law and the revised text of the Real Estate Cadastre Law, following its reform by Law 13/2015, of 24 June.

This is a Certificate drawn up and signed by Topographical Engineers. The Certificate includes a topographical plan that defines geometrically and accurately the enclosure of a specific property in Moraira or anywhere in Spain (plot, dwelling...). The Certificate is generated in an official Reference System of worldwide and unique character.

This includes a GML file (Geography Markup Language) which is a worldwide format for the exchange of geographic information and is used by the Cadastre and therefore by the Land Registry, as well as by Notaries. In addition to the georeferenced topographic map, a list of points measured in UTM must be included.

What is the purpose of locating UTM coordinates in Moraira, Spain?

UTM coordinates must be located so that this information is then accessible in the electronic headquarters when a mapping query is made. In each province and geographical zone a coordinate system is applied, with which the location data of the plots can be extracted.

Steps to follow in order to process it

During the sale of a property in Moraira or Spain, if you are the owner, you must identify at the notary's office which properties are the object of the sale. To do this, you will have to bring the cadastral reference of the properties. The notary will ask you for the cadastral certification and a declaration that the description of the property corresponds to its reality. If this is not the case, a cadastral update process must be initiated.

Either because discrepancies need to be rectified or because an alteration needs to be made to the cadastre, an alternative geo-referenced graphic representation will be necessary. For this purpose, the competent technician will include the georeferenced plan in a computer file that will then be validated in the electronic headquarters of the General Directorate of Cadastre.

The cadastre will issue a validation report, indicating that it now corresponds to the reality of the property. If the procedure with the notary's office is successful, the information is sent to the cadastre so that it is updated in the registry and incorporated into the deed of sale.

This deed is then submitted to the land registry for registration. At this point, the registrar must check the validity of the graphic and descriptive certification of the land registry, qualify the correspondence of the plans with the reality of the property, following the criteria of the law, and process the corresponding registration procedure.

The graphic plan of the property in Moraira or anywhere in Spain can be registered in the land registry without the need for a notary, but for this you must provide the cadastral descriptive and graphic certification or an alternative graphic plan that has previously been validated by the land registry. You must also provide the description of the property according to the title deed, adding the validation of the owner of the property, in case you are not the owner.

Then, when the revised cadastral graphic representation has been registered in the registry, the property is graphically coordinated with the cadastre and from then on, it is understood that the data on the location, limitation and surface area of the property are correct.

Necessary documentation

In order to carry out the procedure it is necessary to present the technical document signed by the topographical engineer and the deeds of the properties, as well as the updates of the same, if any. You will also need to present your personal documentation or that of the owners of the property.

Which professional carries it out

The geo-referenced graphic representation is presented in CAD format with relative coordinates and electronically. For this, it is necessary that an expert in topography, or rather a topographical engineer, works on the plan.

For registration and conformity, a notary must be consulted. In no case can the owner himself be the person in charge of drawing up the geo-referenced plan, although you can be in charge of processing changes to the plan yourself, in case of discrepancies when negotiating a purchase and sale of a property in Moraira or Spain.
