The aim of this basic plot study is the subdivision of the Biasner country estate into building plots.


For the division and location of the resulting plots, the topography, the landscape potential and the correct orientation as well as the existing buildings and roads have been taken into account.


Description

The Biasner estate is located in the municipality of Benissa, between the municipalities of Moraira and Calpe, 5.5 km from the latter.


The property has been previously an irrigated farm mainly occupied by orange trees, it has a natural well of great flow that previously supplied the total irrigated land of the property. The topography of the estate is marked by the succession of terraces characteristic of the area. It is worth mentioning the existence of an ancestral estate with a free-standing porch (riu-rau).


There is also an asphalted road that runs through practically the entire area. This road is mostly public property with the possibility of modifying the layout. This study proposes the modification of the layout only in a part of the sector that crosses plot c.

 

Town planning regulations

The present study follows the provisions established in Law 5/2014, of 25 July, of the Generalitat de la Generalitat, de Orde- nación del Territorio, Urbanismo y Paisaje, de la Comunitat Valenciana of which the following article should be highlighted:


Article 197 Regulation of uses and exploitations in undeveloped land.

Isolated and family housing, complying with the following requirements:

1. It will be permitted to build on plots of uninterrupted perimeter that, both in form and surface area, cover the minimum required according to the planning, which in no case will be less than one hectare per dwelling. 2.o The surface area occupied by the building shall never exceed two per cent of the surface area of the rural property.
In spite of the fact that the General Plan of Benissa 2003 has been suspended, and therefore, it is not obligatory to comply with the new general plan, Benissa Town Council recommends its compliance. Therefore, the present study considers the provisions established in it, highlighting the following title.

 

Title9/Article79-3

In undeveloped land, no population nuclei can be formed. For the non-formation of a population nucleus, the following conditions must be met:

- The plot linked to a dwelling shall not be less than 10,000 m2.
- In a circle of 200 m in diameter there shall be no more than three dwellings.
- The distance between dwellings shall not be less than 25 m.

The pre-existing dwelling is considered protected in the General Plan of Benissa 2003. In the case of being catalogued again as protected in the next general plan, the property will appeal for its decatalogation due to its poor state of conservation. Nevertheless, in the present basic study of the plot it will be considered as protected. According to the calculation of 2% of the plot as occupation and being the occupation of the pre-existing construction around 600m2, the resulting plot will be approximately 30.000m2.


For the calculation of buildability, the Ordinances regulating the aesthetic conditions in buildings located on undeveloped land have been taken into account, considering for the aforementioned calculation the construction of two floors, the first floor being equal to the maximum occupation and the second floor 70% of the maximum occupation.
