1.- Putting down a holding deposit
Once you have found the ideal property, comes the time to negotiate the terms, price and conditions of the sale with the owner. Please note this part of the process is not binding. Once the price has been agreed by both parties, a holding deposit and reservation contract is required to make sure the villa in Moraira is taken off the market. From now onwards we recommend to use the services of an independent solicitor. The sum required for a reservation deposit varies between 3.000€ to 6.000€, depending on the house value. In the reservation contract a time limit for the pre-agreement to be signed will be arranged and legal searches will be made. Important note: Should the house you are interested in have legal problems, the sum paid as reservation deposit will be transferred back to you.
2.- Private Contract in Moraira, Costa Blanca, Spain (Contrato privado de compra-venta)
The contract will set out the terms and conditions under which both buyer and seller agree to complete the purchase of the Moraira property. The private contract should be written or supervised by your independent lawyer and relevant details will be included for example the legal property details, purchase price and completion date amongst others. At this point a down payment of 10% of the agreed price is required. This agreement will include a penal clause if the sale does not go through. Should the seller decide to pull out of the sale, the compensation for the buyer (you) will be double the deposit pad, on the other hand should you decide to pull out of the sale then your deposit will be lost in favour to the seller. Deep legal searches on the villa will be made before signing this contract.
At this point we advise to have set up a bank account in Spain and obtained the tax number in Spain (NIE).
3.- Completion at the Notary, Spain (Escritura de compra-venta)
The completion of the sale will take place in front of a Spanish Notary. A Spanish public official, by law the deed of sale must be witnessed by a public notary. Your independent lawyer will be with you and act on your behalf. The official document (Escritura) will be readed in both Spanish and English. On completion the buyer pays the balance. Both the purchaser and the seller have to sign the deeds (escritura). An official copy of the title deeds will be given to both purchaser and seller. The notary will also sent a copy to the land registry.
PLEASE NOTE: Currently the taxes involved when purchasing a Moraira villa are around 13% (including the Notary, Land Registry, Lawyer and Tax)
